如何更好地收集、審查與運(yùn)用電子數(shù)據(jù)，對(duì)海量的電子數(shù)據(jù)進(jìn)行分析，使之成為指控犯罪的有力證據(jù)，是當(dāng)前檢察技術(shù)人員亟待解決的新課題。河南省西平縣檢察院不等不靠，大膽探索，形成國(guó)一套行之有效的管理方式，一方面，購(gòu)置DEC電子物證勘查箱等技術(shù)裝備，確保嫌疑計(jì)算機(jī)精確拷貝、無(wú)損復(fù)制;另一方面，積極組織學(xué)習(xí)相關(guān)知識(shí)，結(jié)合實(shí)際開(kāi)展電子數(shù)據(jù)應(yīng)用，積累實(shí)踐經(jīng)驗(yàn)，取得明顯成效。

2014年底，某醫(yī)院收費(fèi)員張某聲稱(chēng)收費(fèi)系統(tǒng)故障導(dǎo)致現(xiàn)金虧空，無(wú)法交賬。醫(yī)院請(qǐng)來(lái)軟件商分析，無(wú)明確結(jié)論。該縣檢察院接受上級(jí)指派受理后，認(rèn)為應(yīng)當(dāng)對(duì)此進(jìn)行數(shù)據(jù)分析。該院技術(shù)科人員對(duì)偵查人員進(jìn)行技術(shù)指導(dǎo)，遠(yuǎn)程控制技術(shù)導(dǎo)出收費(fèi)軟件數(shù)據(jù)，并對(duì)取證過(guò)程進(jìn)行屏幕錄像。技術(shù)人員經(jīng)過(guò)電子數(shù)據(jù)進(jìn)行比對(duì)，發(fā)現(xiàn)該醫(yī)院收費(fèi)軟件部分模塊數(shù)據(jù)稽關(guān)系不正確，但是，其收費(fèi)結(jié)算計(jì)算正確，認(rèn)定張某應(yīng)當(dāng)對(duì)短款承擔(dān)責(zé)任。在此案辦理過(guò)程中，技術(shù)人員封存原盤(pán)，只在復(fù)制盤(pán)上進(jìn)行分析，把保真放在第一位，同時(shí)做到對(duì)涉案醫(yī)院商業(yè)秘密、病員隱私負(fù)責(zé)，不影響醫(yī)院業(yè)務(wù)正常開(kāi)展，受到各方好評(píng)。近年來(lái)，該院受理或接受上級(jí)指派，協(xié)助鑒定人辦理電子數(shù)據(jù)分析8次，通過(guò)電子數(shù)據(jù)分析查獲涉嫌犯罪金額660多萬(wàn)元，7名涉案人受到法律追究。
